Nalutsyshyn V. Criminal liability for hooliganism (article 296 of the Criminal Code of Ukraine).

The thesis is the first complex monographic research of the criminal hooliganism (Art. 296 of the Criminal Code). Historical and comparative-legal aspects of the normative definition of hooliganism have been considered; terminological and substantial signs of this crime, their compliance with the legal nature of hooliganism have been analyzed, and the author's vision has been proposed; the problem and controversial questions of objective and subjective signs have been investigated; the definition of the crime object, ways of its committal, qualified and especially qualified signs, marking off the criminal action (stipulated by Art. 296 of the Criminal Code) from related components of crime, particularly, crimes against human health, property, etc. have been specified. It is offered to improve the constitutive, qualified, and especially qualified signs of the components of crime (stipulated by Art. 296 of the Criminal Code), to aggravate the criminal sanction for the hooliganism and the author's wordingof Art. 296 of the Ukrainian CC.
