Essay

The dissertation is devoted to the theoretical, legislative and methodological problems of administrative - law qualification of abuse of monopoly state. Logical and methodological prerequisites of definition concepts “qualification of the administrative offence” and “dominant state” are described. Corresponding definition are formulated. On the basis of analysis of national legislation, administrative and trial practice, statistical data, necessary of wide spectrum of changes to article 166-1 Administrative Code of Law and some corresponding Laws is substantiated. Important practical recommendations have been made.
