Essay

The dissertation presents a complex theoretical and legal analysis of problems regarding implementation of the public and legal status of state banks. It examines the influence of financial and legal regulation on relations which appear in the process of creating and operating state banks. It proves that the state bank’s actual realization of its functions, the execution of certain programs, etc make part of the state’s financial activity concerning the distribution and utilization of the state’s public funds. Bordering on social, economic and investment regulation is the method of the state’s financial activity aimed at financing and crediting the economy’s priority spheres as well as creating conditions for a further mobilization of financial resources for the accomplishment of the state’s tasks and functions, including those envisaged in the middle- and long-term prospects of state expenditures. The dissertation analyzes the formation and development of the savings business in the Ukrainian territories since the late 18th century, including the Soviet period, as well as the current state of the savings business and repayment of state-guaranteed savings to depositors of the Savings Bank of the Ukrainian SSR in different periods. The dissertation characterizes the legal status of development banks, gives their classification and defines their peculiarities. It offers a comparative legal analysis of legal regulation of the development banks of Croatia and the Republic of Kazakhstan, whose experience can be partially applied to Ukraine in the process of forming a legal basis for state banks in the near future. Thus the dissertation formulates theoretical and practical conclusions as well as proposals for improving current legislation in this sphere and optimizing the functioning of state banks in Ukraine.
