Nikolayenko T. Discharge from Criminal Liability on the Grounds of Admission to Bail

This thesis presents the complex scientific analysis of the discharge from criminal liability on the grounds of admission to bail. It covers the process of formation and development of the procedure of discharge from criminal liability, including the discharge from criminal liability on the grounds of admission to bail. The work contains the notion, grounds, conditions and types of discharge from criminal liability. On the basis of the conducted research some suggestions concerning the application of the discharge from criminal liability on the grounds of admission to bail and the ways of punishment in case of the violation of the admission to bail conditions are put forward. Amendments and additions to the resolution of the Plenum of the Supreme Court of Ukraine (December 23, 2005; №12) "On the Practice of the Administration of Laws on the Discharge from Criminal Liability by the courts of Ukraine" are introduced. A new version of Article 47 of the Criminal Code of Ukraine is brought in.
