A comparative-legal research of the processes of formation, development and functioning of the Institute of the President of France, Russia and Ukraine on the basis of generalization of the results obtained on the issue by domestic and foreign researchers and the analysis of the constitutional norms and a political practice are carried out in the dissertation. The reasons of the introduction of the post of the president and the factors, which influenced the formation of specific traits of French, Russian and Ukrainian institutes of the presidency, are investigated. A central place is assigned to the research of a legal and actual status of the presidents in a mechanism of realization of a State power of the countries. The constitutional functions, authorities and the problem of the exceeding of the authorities as a source of the conflicts between the Head of the State and the Parliament are analyzed. The attempt of the analysis of the role and place of legal acts and the auxiliary bodies under the Headof the State in the implementation of his functions and duties is made in the thesis for the first time.
