Dissertation is devoted to the analysis of criminalno-pravovih problems of criminal responsibility for creation of the militarized or armed unit not ponderable by a law. The grounds of criminalization of this act are studied, given criminalno-pravova description of the crime foreseen to the item 260 of CC Ukraine. It is specified on no exactness of separate terms which are used in an item 260 of CC Ukraine. Are determined to direct and additional objects of this crime. The forms of accomplishing of objective side are explored in detail. The necessity of revision of question in relation to the subject of the indicated crime is marked. Coming from the results of research, an author determines the lacks of item 260 of CC, offers the proper changes at CC Ukraine.
