Сhertkova I. Public and private tendencies in the development of Ukrainian labour law.

For the first time the dissertation is dedicated to the research on the problem of public and private tendencies in the development of modern Ukrainian law. The author displays general trends of strengthening of public intervention into the labour relations and ways of increasing labour contract part in their (labour relations) regulation. Spetial attention is given to deregulation of labour and incidental relations. The author proposes to extend the sphere of influence of Labour law over all relations of work accomplishment by natural persons and intensify public intervention into labour relations of the state employees for guaranteeing of the contest during selection of staff, ensuring of the appropriate control over state employees activity and appreciation their business merits and work and work results. The problem of tightening control and supervision over Labour law compliance is also examined in the dsissertation. The author proves necessity of accordance to the parties of labour contract morepossibilities of handling their relations by their mutual consent and proposes to delete law dispositions when they serve as displays of unjustified public intervention into the labour relations.
