Golubeva G. Administrative-legal qualification of infringements by drivers of the motor vehicles operation rules

The thesis is devoted to consideration of the theoretical, legislative and practical problems of the administrative and legal qualification of infringements by drivers of the motor vehicles operation rules. The corpus delicti of the administrative offences, the responsibility for which is provided by the clauses 121, 121-1 of the Code of Ukraine of the Administrative Breaches of Law is analyzed in the given paper. On the basis of the analysis and generalization of the practice of the State Traffic Inspectorate, courts of general jurisdiction, as well as on the basis of the results of inquiries of the motor-vehicles' drivers of all categories and authorized qualification subjects, they ground the necessity to make changes in the current Code of Ukraine of the Administrative Breaches of Law, Road-Traffic Rules, legislative acts of the President of Ukraine, Cabinet of Ministers of Ukraine, Ministry of Transport and Communication of Ukraine, and state standards of Ukraine. They developed the methodical recommendations concerning the improvement of supervision by the State Traffic Inspectorate over the traffic safety.
