Kabalskiy R. The Philosophical Reasoning of Law's Normativity.

The dissertation focuses on research of normative aspects of legal rules as their constituent characteristics, presents its notion and peculiarities of functioning in transforming societies. The author completed deep analyses of different philosophic approaches to the question of law normativity, beginning from the ancient times and including modern concepts. The legal nature and elements of law normativity in the system of society are given. Correlation and codependence of social normativity and the sphere of due values are revealed. The author emphasizes social and cultural backgrounds of legal normativity. A number of social regulations are viewed simultaneously through their integrity and specifics. The notion of law normativity and its constituent characteristics are presented. Law normativity and legal enforcement are researched as complements of an integral system. The role of legitimation procedures in development and functioning of law normativity is shown. Based on codependence of transforming societies and their legal systems distinctive features of Ukrainian legal system are named.
