Gurtieva L. Ethical principles of investigator's activity.

The thesis is a complex research of theoretical and practical problems of ethical principles investigator's activity dealing with the institution and investigation of criminal case. Definition, nature and subject of the theory of investigative ethics as well as definition, contents and structure of investigator's activity ethical principles have been defined in work. Such elements included into the structure of ethical principles of investigator's activity as moral and legal consciousness of investigator; moral and legal aspect of aim, means and result of investigator's activity; ethical and legal aspect of investigative practice have been studied. According to the axiological approach, comparative and legal analysis of legal provision of person's moral values at the prejudicial stage of criminal procedure under the international legal norms has been researched and the directions of improving of the legal mechanism have been denoted. Moral and legal criteria of reasons, conditions and borders of limitation of person's rights to liberty and personal privacy during investigation and preventive measures, specifically detention, have been determined. The system of moral and legal norms which are acceptable in tactical verbal methods of investigation has been determined here. Scientifically substantiated proposals directed to improve legislation in force and to elaborate new CPC of Ukraine have been proposed."
