Strel'tsova O. Sources of law for European Union (theoretical aspects)

The thesis is devoted to the investigation of theoretical aspects of sources of law for European Union. With the purpose of forming of methodological grounds for the analysis of sources of law for European Union, the conceptual approaches to the determination of concept ,,source of law" are researched, the analysis of sources of law according to the levels of law-making process is made and separate types of formal sources of law are considered. The material, ideological and institutional sources of law for European Union are defined and consistently described. The classification of formal sources of law for European Union in accordance with the generalized criterion - the forms, which are the embodiment of obligatory legal orders of institutes and organs of European Union and states-members, is conducted. The sources of original and second law (legislations) of European Union, treaty law sources, case-law sources and general principles of law are analyzed. On the basis of studying all factors, which defined the content of law for European Union and forms of its expression, general theoretical basis for forming of scientific conception of sources of law for European Union is created.
