Kukhniuk D. Judicial precedent, as the source of criminal procedural law of Ukraine.

The thesis is devoted to the complex research of judicial precedent, as a source of criminal procedural law of Ukraine. Author examinees the legal nature of judicial precedent, determinates the concept and characteristic of the system of sources of criminal procedural law of Ukraine Author proved the necessity of official recognition of judicial precedent as a source of criminal procedural law of Ukraine, and suggested the mechanism of its effective. Author formulates conclusions concerning legal nature of acts of courts of judicial system of Ukraine and European court of Human rights in context of stare decisis doctrine. Candidate for a degree formulates the suggestions relative to improvement of criminal procedural legislation aimed at promotion of court role in criminal procedure and assigning the characteristic of judicial precedent to the decisions of Supreme Court of Ukraine
