Avtorhov A. The Administrative and Legal Status of a Public Enforcement Officer

The dissertation is dedicated to studying the administrative and legal status of a public enforcement officer. Based on study of historic and legal background and development of the judgment enforcement institution, stages specific to the main historic periods (from Х to ХХ centuries, soviet and Ukrainian) have been distinguished. Such definitions as "state enforcement service" and "state enforcement officer" have been proposed. Features distinguishing a public enforcement officer have been assigned. It has been proven that the administrative and legal status of a public enforcement officer is a separate legal status of a person conditioning specifics for exercising by it some of the constitutional rights and freedoms. It is defined that the legal status of a public enforcement officer is based on the legal status of a person and consists of the following elements: official legal personality, duties and rights, competence, legal responsibility. Elements of the administrative and legal status of a public enforcement officer have been analyzed in details.
