Overkovska T. Legal grounds of land preservation from pollution and spoilage in Ukraine.

The legal grounds and conception of preservation of land in Ukraine from pollution and spoilage are examined in the thesis. As a result of this examination main features of the conception of land preservation from pollution and spoilage are defined; historical and juridical analysis is performed concerning formation of Ukrainian legislation dealing with land preservation from pollution and spoilage; the actual state of the current legislation of Ukraine in the sphere of preservation of land quality is analysed and ways of improvement of the legislation are proposed. The concepts of "land pollution" and "land spoilage" are examined and relation of these concepts is determined. The legal grounds of land preservation from pollution and spoilage in Ukraine are analysed. The conception of responsibility in the sphere of land preservation from pollution and spoilage in Ukraine is explained by means od positive and retrospective responsibility, particularities of the legal liability in this sphere are described, conception of the legal liability for deterioration of land quality is proposed.
