Essay

This dissertation is one of first special monographic research papers in Ukraine dealing with legal regulation of social relations relative to computer programs (software) as an institute of information law. By means of analyzing historical pre-conditions of social and legal regulation of social relations as to software and studying the place of social relations as to software in the system of the legal regulation, the scientific idea that software is a prominent factor in formation of information society has been substantiated. The phenomenon of a computer program as a subject of different branches of law has been studied. The necessity of defining the social relations in relation to software as an inter-branch complex institute on the basis of particular branch institutes in information law has been proved. In the dissertation certain attention was paid to the directions of state regulation in the field of software usage. It was shown that it is necessary to apply systematization of information legislation by means of codification, taking regulation of social relations as to computer programs into obligatory account. Farsighted ways of reforming the information legislation concerning regulation of social relations as to software have been suggested, on the basis of which the propositions regarding provisions of the project of the Information Code of Ukraine have been formulated.
