Palekhov D. Legal Foundations for Strategic Environmental Assessment

The aim of this dissertation is a comprehensive study of the legal nature and mechanism for legal provision of strategic environmental assessment. The characteristics of strategic environmental assessment as an independent legal phenomenon are revealed: its idea, functions, aim, objectives, its objects and subjects are defined; time periods in the history of formation of the modern concept of strategic environmental assessment are given. The scope of a legal procedure of strategic environmental assessment is analysed. Objectives of strategic environmental assessment in creating legal conditions for realization of the basic environmental rights of the people (citizens) are investigated. The special attention is directed to the guarantees of strategic environmental assessment, the necessity to adopt an individual legal act - the Law of Ukraine on strategic environmental assessment is justified, and its conceptual draft is proposed.
