The paper outlined the results of complex criminal law and criminological research amnesty application and implementation of clemency on the territory of Ukraine. Analyzed legislation on the use of amnesty and pardon in the history of law, comparative law and formal and legal aspects. Consider the place and role of criminal law policy in the scope of amnesty and pardon in the system of state criminal law policy. A study concepts and features of institutions amnesty and pardon, as well as regulatory settlement of these institutions on three main levels: the constitutional, legislative, pidzakonnomu.
