Essay

The present thesis is the first in Ukrainian science consecutive research study of Neo-Thomism tendency in French philosophy of law within the frames of Jacques Maritain conceptions. The impact of various confessions in modern philosophy of law have been studied. The methodological criterions for secular analysis of conceptions of religious thinkers and philosophers have been worked out. The reasons and conditions that provided the restorations of Thomism in catholic philosophy of law were detailed. The encyclic Aeterni Patris and its influence on the restoration and spreading around Thomas Aquinas philosophy in modern philosophy in general and in philosophy of law in particular have been analyzed. "Summa Theologiae" made up the background for performed investigation of basic Thomistic model of philosophy of law, which makes the base for new developments of the modem French philosophers. The specificity of modern French catholic philosophy of law within the frames of its national and internationalcontent have been cleared out and formulated; the possible directions of interaction and reciprocal influence of catholic and laic philosophy of law in Ukraine have been indicated. It has been proved that the Maritain's statements about priority of human individual rights and political society, about priority of the state in the development of political nation and restraining of political extremism, creation by political society the system of efficient civic control over the government are particular important and up to date for construction of Ukrainian state.
