The thesis is devoted to the theoretical and practical problems complex research which emerge during the claime, consideration and resolution of the motion in criminal procedure of Ukraine. The author researches the issue of the motion in criminal procedure, its procedural nature, essence, structure, classification. The special attention is paid to the procedure of claiming and motions consideration at various stages of pretrial proceedings in the court. The number of proposals as for introduction and annexation to the current legislation and draft of Criminal Procedural Code of Ukraine vested and formulated.
