Essay

This dissertation is the first research in Ukraine which makes complex legal-comparative analysis of the theoretical and practical problems which may occur during the application of measures limiting rights and freedoms of persons who participate in criminal justice process in the pretrial stages in Ukraine and Anglo-American legal system represented by the USA and the Great Britain in the context of international standards. The content of international standards which regulate application of enforcement measures is revealed, these standards serve as model in the process of comparison. Problems arising in the process of enforcement during application of preventive measures and investigative actions, which may be conducted with the use of force, are studied. The result of the study of English and American legal systems stipulates formulation of definite proposals aimed at the improvement of current procedural law of Ukraine to provide real protection of the rights and freedoms in the process of application of enforcement measures.
