Kursova V. Ecolojical-lawful regulation of quarantine of plants

Dissertation is complex scientific research of ecologic-lawful regulation of quarantine of plants. It is defined the ecologic-lawful maintenance of "quarantine of plants" concept and it is carried out the delimitation of this concept from contiguous with it terms. The review of development of institute of quarantine of plants is conducted in the system of Ecologic law. The author generalized current ecological national and international legislation on quarantine of plants; on this basis the functions and jurisdiction of public and local self-government authorities are analyzed in industry of organization and realization of quarantine plants. The features of quarantine regime are described as to variety of legal modes of extraordinary ecological situations. The analysis of quarantine (phytosanitary measures) is conducted and their classification is carried out. Suggestions and recommendations directed on improvement of mechanism of ecologic-lawful adjusting of plants' quarantine are developed. It is examined the grounds of legal responsibility for violation of legislation on quarantine of plants.
