Borets T. Investigative actions in dwelling and in other person's ownership

Dissertation is dedicated the complex exploration of the main problems during the conduction of investigative actions in dwelling or in other person's ownership. Having accomplished the analysis of the effective legislation of Ukraine and ratified international acts, having explored the materials of investigative practice and the opinions of investigators of separate investigative subdivisions, author uncovered the judicial peculiarities of the conduction of the above-mentioned investigative actions. Besides, in the dissertation are explored such definitions as "investigative action", "dwelling", "other person's ownership", are defined main features, nature and the assignments of the investigative actions that are conducted in dwelling or in other person's ownership, are uncovered the procedural criminal guarantees of the ensuring of person's rights during the conduction of investigative actions, are delineated the prosecutor's supervision and judicial control. Also author substantiates own proposals of upgrading of the procedural criminal legislation of Ukraine which defines the judicial order of the conducting of investigative actions (including in dwelling or in other person's ownership).
