In the dissertation the history of development of institute of Nec-essary Defence is researched. Legal regulation of Necessary Defence in the foreign states is analysed. The socially-legal nature of institute of Necessary Defence is found out, and also the concept of Necessary De-fence is given. Criminological aspects of the right to Necessary Defence are re-searched.
