Shumylo M. Regulation of Pension Provision for Civil Servants.

The dissertation is a comprehensive study of current theoretical and practical problems in legal regulation of pension provision for civil servants. The thesis explores development of legal regulation of pension provision for civil servants and international experience in the field. The dissertation determines the notion of the pension, defines pensions classification and types, subject and legal composition of civil servants’ pensions, legal personality, content of procedural legal relations with respect to pension, effect of a crime on such relationships, sense of simple and complex legal facts, and a special civil servants’ term of service. Great attention is given to particularities in origination, alteration and termination of pension provision for civil servants as well as the pension amount and its calculation procedure. On the basis of the study, specific proposals were formulated as for improving the current legislation regulating pension provision for civil servants, which allows enhancing the existing system of pension provision for civil servants, harmonizing it with general pension provisions and contributing to abolishment of several discriminative provisions."
