Essay

The thesis focuses on criminal liability for violation of laws and customs of war. The author examines the history of the legislation on criminal liability for this crime, its objective and subjective elements and specifies its distinctive features compared to adjacent crimes. The author also proves the necessity of harmonization of the Special Part of the Criminal Code of Ukraine by incorporation of criminal norms on liability for war crimes into a separate section. The author makes recommendations for improvement of Article 438 of the Criminal Code of Ukraine and lays down new wording for this article.
