Moskal D. Criminal-legal characteristics of rape and forcible satisfaction of sexual passion in perverted forms

The dissertation presents complex and system criminal-legal characteristic features of rape and forcible satisfaction of sexual passion in perverted forms. The notion and system of crimes are defined which are tied with sexual violence, the place and essence of rape and forcible satisfaction of sexual passion in perverted forms in this system are determined. The paper presents research of historical development of criminal responsibility for rape and forcible satisfaction of sexual passion in perverted forms. Foreign criminal-legal standards of counteracting to crimes connected with sexual violence are studied. "Corpus delicti" of rape and forcible satisfaction of sexual passion in perverted forms according to the criminal law of Ukraine have been analyzed. Peculiarities of qualification of the mentioned crimes are defined as well as their differentiation from the adjacent infringements. The conclusions have been drawn and propositions formulated which are directed to the improvement of criminal-legal norms in the area of protecting of sexual freedom and sexual inviolability of a person as well as to the raising of effectiveness of law-enforcement practice.
