Kravchenko O. Criminal-legal characteristic of smuggling (art. 201 of the Criminal Code of Ukraine)

The thesis covers a complex of problems connected to features of the criminal liability for smuggling. On the basis of the analysis of domestic and foreign legislation necessity of improvement of edition of the article 201 of the Criminal Code of Ukraine is proved. The criminal-legal characteristic of this structure of a crime is investigated, its elements and attributes are analyzed. Improvement of part 1 of article 201 of the Criminal Code of Ukraine and introduction of the new qualified and especially qualified structures of this crime are offered. Offers for improvement of the criminal legislation are given in connection with necessity of change of edition of an article 201 of the Criminal Code of Ukraine.
