Movchan R. Criminal Liability for Unwarranted Taking of Land and Unwarranted Building

The dissertation is devoted to researching the problems of criminal liability for unwarranted taking of land and unwarranted building. The historical experience of fighting against unwarranted taking of land and unwarranted building is analysed. The legislative decision to adopt the art. 197-1 of the Criminal Code of Ukraine is contemplated. Objective and subjective legal characteristics of the crime, prescribed by the art. 197-1 of the Criminal Code of Ukraine, are considered. Sanctions, prescribed by the art. 197-1 of the Criminal Code of Ukraine, and the trends in application of punishment for this crime are analyzed. Recommendations concerning application of the art. 197-1 of the Criminal Code of Ukraine are worked out. Propositions aimed at improvement of the norm in question and land legislation in the part that defines the term "unwarranted taking of land" are formulated.
