Donchenko O. Freedom as a Category of Law

The dissertation is devoted to the philosophical legal research of freedom as a category of law on the basis of combination of ontological, gnoseological, axiological and methodological characteristics with the purpose of determining its structural and functional content. The dissertation proves that freedom as a form of creative self-realization of personality is a formal semantic category of modern law of Ukraine which is based on dynamic unity of natural law principles and positivistic principles. Positive law and its norms are the formal basis of freedom and natural and inalienable human rights, vital needs and interests are the semantic basis of freedom.
