Meleh L. Legality in the law-enforcement fctivity.

The dissertation is devoted the complex study of legality in the law-enforcement activity as the social-legal and cultural phenomenon which carries out the stabilizing and progressive-evolutional influence on development of social relations. The concept of legality, its form, structural elements, essence and content are investigated, correlation of legality and lawfulness is established. The methodological basis of the research is defined. The main features which determine the legal nature and the specificity of the application of law as the particular form of its realization taking into account the non-linear character of development of social relations are considered. The factors which affects the law-enforcement in law-enforcement process, including atypical situations, that arise during the solution of legal cases, are set and analysed.The concept of the principles of legality as fundamental ideas, which determine the essence of this complicated and varied social-legal and cultural phenomenon, their system character are described, the criteria of the distinction between priciples and requirements of legality are defined.
