Furman Y. The fundamentals of methodology of investigation of cultural property smuggling

The structure of criminalistical characteristic of cultural property smuggling, which includes the subject of criminal infringement, modus operandi, "trace picture" of smuggling, offender's identity, are described in the research. Typical investigation situations of the mentioned crime are specified on the basis of the research of investigation practice and scientific sources. Typical cases on cultural property smuggling classified according to the objective aspect of crime, sources of the obtained cultural property, ways of its transportation through customs control, ways of concealment, distribution and storage area, quantity of the episodes of the criminal activity, subject and subject party of the crime are proposed on the grounds of the investigation situations.Author examined the tactics of investigation inspections, appointment of forensic inquiries, stop-and-search procedure, interrogation, seizure, reconstitution of the crime, certification and submission for identification.The formulation of the scientific statements of the methodology of investigation of cultural property smuggling is the result of the research.
