The dissertation is dedicated to philosophical-basic research of the development and contents equality as category of philosophy of law, made by way of the critical analysis, comprehensions and generalizations both histories philosophical-legal thought, and modern achievements of the legal science. Coming thereof, is made qualitative renovation to concepts equality as one of the main principle modern law. Given new understanding equality - an idea, which is displayed in creation and joining general, for all participant of the public relations, legal instrument with system of the exceptions from the general mode of the legal regulation for separate subject, for the reason provision practical equality their rights and duties.
