The thesis is a research wherein relevant legal, theoretical and practical issues of implementing criminal and procedural activity performing by individuals with notarial functions have been studied at a monographic level. The cases of the use of information which contain a notarial secret in a criminal process, existent criminal process guarantees of guard of notarial secret, are considered. It is well-proven that the guard of notarial secret requires the special order of lead through of separate procedural actions.
