The paper is the first comprehensive and systemic study of criminal and legal issues of air protection in Ukraine. Based upon the international, national and foreign experience, it offers a number of new theoretical, practical and legislative provisions and conclusions regarding the criminal and legal aspects of air protection in Ukraine. To achieve the goal, a research has been provided exploring the sources and genesis of norms that establish criminal penalties for air pollution on the territory of Ukraine, the concept and the social danger of the above crime have been analysed.
