Dzyubenko O. Juridical technique of departmental creation of regulatory acts in Ukraine

The controversial issues of legal technique are investigated in dissertation, examined are its kinds. At the same time, such theoretic legal categories as law-making, rulemaking and creation of regulatory acts are analyzed. On the basis of analysis of types of legal technique and methods of departmental creation of regulatory acts author's definition of "legal technique of departmental creation of regulatory acts" concept is formulated, examined are its kinds and constituents, among which are: rules, means, approaches and methods. It is being proved that the rules of legal technique of departmental creation of regulatory acts are to be divided after the criterion of its kinds. Thus, the special attention is given to the rules of department acts norms development which include those of external registration of departmental acts and of departmental acts texts exposition. Determined are a core and types of departmental subordinate acts, which are the result of departmental creation of regulatory acts. Principles of right, which are used in departmental creation of regulatory acts, are described. The state of legal technique of departmental creation of regulatory acts in Ukraine is reflected. Offered are the ways of its improvement.
