Slinko D. State and Prospects of Consensual Procedure in Criminal Process. Ukraine

The thesis is devoted to the consideration of consensual procedure in criminal process. The factors, forms, limits of consensual procedure have been determined. In has been uncovered the model of the consensual procedure, which is built on the adversarial principle of criminal process. It has been investigated the consensus of the person who cooperates with the inquiry organ, the investigator, the procurator and the court concerning unmasking of criminal band leaders. It has been given the view on the accusation as the criminal suit, which is subject to judge consideration. It has been established that the grounds for conducting of simplified judicial examination of criminal case is the absence of objections between parties. Considerable attention has been given to the investigation of criminal case on the stage of preliminary investigation and simplified procedure.
