A dissertation was devoted to the complex study problems of realization of function of defence in the criminal process of Ukraine, and also perfection of legislation of Ukraine which regulates activity of subjects of function of defence in a criminal process. Investigational question of becoming and development of function of defence in a criminal process, concept of the indicated function, its place and role, in the criminal legal proceeding, correlation of legal categories "defence", "right of defence", "function of defence", description of subjects of function of defence, determination of their plenary powers and marketabilities last, on the different stages criminally judicial activity, judicial status of defender.
