Mykytyn J. Restorative Justice in Criminal Procedure: International Experience and Prospects in Ukraine

The dissertation is dedicated to the complex analysis of theoretical and practical problems of restorative justice in criminal procedure. The essence, historical basis and forms of restorative justice are considered in the work. The concepts and principles of restorative justice are analysed, characteristic form of restorative justice is made, and history of criminal procedural policy in the sphere of reconciliation and mediation in Ukraine is analyzed. In this research the analysis of consolidation of restorative justice in international instruments and the European experience of its implementation and application is held. The author consideres preconditions for the implementation of restorative justice in Ukraine and ways of its implementation. The changes to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine are proposed.
