Smolyrova M. Labour contract with scientifically-pedagogical personnel.

Based on the theoretical conclusions and analysis of Ukrainian general labour law and special legislation on education, which regulate making, modification and breaking of the labour contract with scientifically-pedagogical personnel, theoretical and practical problems of labour law administration were identified. These problems are connected with the accrual of employment relations with scientifically-pedagogical personnel, with definition of the parties of the labour contract with scientifically-pedagogical personnel, with determination of terms of the labour contract with scientifically-pedagogical personnel, with celebration of separate kinds of labour contract with scientifically-pedagogical personnel (holding more than one job, per hour employment system, contract), with alteration of labour contract with scientifically-pedagogical personnel, with certification of scientifically-pedagogical personnel, with cancellation of a labour contract with scientifically-pedagogical personnel on scientifically-pedagogical worker's and proprietor's or his authorized body's initiative. In the dissertation much attention is paid to characteristics of scientifically-pedagogical personnel's legal status, which differentiate them from other categories of workers. The criteria of the differentiated approach to the regulation of employment relations of scientifically-pedagogical personnel were defined as well. There are developed and introduced proposals regarding the improvement of scientifically-pedagogical personnel's labour legal control. Conclusions have been drawn and proposals have been made on the introduction of changes and amendments to the separate assets of the current legislative acts such as The Labour Code of Ukraine, The Law of Ukraine On Education, The Law of Ukraine On Higher Education, Regulations on choice and employment of scientifically-pedagogical personnel in institutions of higher education of third and fourth accreditation levels, etc.
