Pozhar V. Institute of representation in criminal proceeding.

The thesis deals with the development of the systematic conception of contemporary representation institution in the criminal legal procedure, disclosure of problematic issues of its implementation and formation of the means of their solution. The research work considers the issue of genesis and contemporary state of the institution of representation in the criminal legal procedure; the thesis investigates the notion and signs of representation and gives its classification on various grounds. The notion of a representative as a subject of criminal procedural activity has been worked out. The research work defines the prerequisites and conditions necessary for the acquisition of the procedural status of a representative by a certain person and the preconditions for the loss of them. In the thesis, there have been analyzed the following issues: the problems of legal regulation of the complainant, injured person, civil claimant and civil defendant; representation of legal entities; public prosecutor’s representation of the interests of citizens and the state and the issue of witness representation. The author suggests the ways and means of solution of the issues researched.
