Shilin D. Prejudices in the criminal procedure.

The dissertation is dedicated to the complex analysis of applying prejudices in criminal procedure, detection of the possible ways of improvement of the mechanism of realization prejudices in criminal procedure. The author deals with perfecting the legal nature of prejudices and the ratio of adjacent categories; the mechanism of realization general, civil procedure, commercial procedure, administrative and administrative procedure prejudices in criminal process. Application of the prejudices in the process of proving in a criminal case have been researched, including the prejudices of acts of organ of inquest, investigator, public prosecutor. The thesis analyzes prejuciality of court decisions in criminal cases. The ratio of prejuciality of criminal procedure acts and the principle of free evaluation of evidence are examined. The ways of resolution of the prejuciality collisions in the process of proving are defined.
