Kovtun N. The conception, system and types of additional penalties for minors

The complex research of additional penalties which can be applied to minor offenders in accordance with valid Criminal Code of Ukraine is carried out in the dissertation. New theoretical ideas which concern the conception of additional penalties for minors, the system of these penalties, and their functional mission in the criminal liability mechanism of minors are formulated. It is well proved that additional penalties are directed to the same aims as basic punishment. It is thus important to mark that additional penalties are able not only to strengthen influence of basic punishment, but also on occasion they help to avoid unjustified severe punishment. Thus, recognition for additional punishment an auxiliary role in the criminal liability mechanism of minors not a bit allows considering them second-range means in the mentioned mechanism. Taking into account the international standards which concern features of criminal liability of minors, national and foreign legal experience, concrete propositions of improvement of existing additional penalties for minors and also their new system are given in the dissertation.
