Konyushenko Y. Proving at the precourt procedures in the criminal process of Ukraine.

The dissertation is devoted to the research and improving of theoretical and practical problems of proving at the precourt criminal procedures. The essence and the peculiarities of it is analyzed, the state of its research in the scientific literature is considered, the meaning of the proofs, the process of proving and its subjects are defined, the new criterion of their classification is elaborated. The stages of it, its functions, the aim of the criminal procedure of proving at the precourt part of process are defined. The peculiarities of proving, its subject and border at the stages of opening of the criminal case and precourt investigation are defined. The ways of simplification of criminal procedures at these stages are defined too. The ways of optimization of the procurator's control, court control and inner control of the proving are outlined. The scientifically grounded proposals for the improving of criminal procedure legislation of Ukraine are given.
