Strelnik O. The circumstances that expel responsibility.

In this thesis research the circumstances that expel legal responsibility and the formulated author's understanding of conception of these circumstances in general legal theory are examined, the universal circumstances that expel legal responsibility and apply to all branches of law as a result of their generality, universal character are analyzed here. The attitude of the author of the thesis research to traditional division of legal responsibility into positive and negative is defined here, according to this attitude this division doesn't correspond to legal nature of legal responsibility, so as moral but no legal estimation lies in the foundation of positive responsibility. The responsibility must have grounds. The positive responsibility has no grounds, since it is a phenomenon of moral character.
