This thesis carried out a philosophical and theological understanding of Islamic sacred and doctrinal texts as sources of Muslim law with the defining of religious and legal nature of the Koran and sunna (the materials "Sahihu" Al-Bukhari) with the transformation of the evolution of the Muslim concept of hidjra the period of formation of national states and the fundamentals of globalization Islamic doctrine of "jihad". Revealed the Koran as a sacred text of Islam saturated many rules and regulations that are imperative and wide within the interpretation and have great potential to demonstrate, firstly, in establishing religious boundaries of the legal initiative.
