Vakulik O. Criminal Сharacteristic of the Compulsion of Evidence

Thesis is the first native complex monographic research of an evidence compulsion criminal characteristic. The author analyzes the development of Ukrainian and foreign legislation concerning criminal responsibility for the compulsion of evidence. Problem issues of the evidence compulsion objective, subjective and qualificatory badges are considered. The author distinguishes the actions, viewed by the article 373 of CC of Ukraine, from the adjacent offences. Some drawbacks of the domestic criminal legislation concerning criminal responsibility for the compulsion of evidence are mentioned and several proposals for their elimination are made
