Stasyuk S. Historical and legal tradition of the armed conflicts regulation

The thesis deals with systemic analysis of international aspects of modern military conflict regulation in context of the established historical and legal tradition of compliance with the rules of warfare. It analyses the evolution of historical and legal tradition of regulation of the armed conflicts, elucidates the regularity of transition from syncretical customary law to the extensive system of codified international armed conflict law. It examines the historical reasons for the origin and development of Ukrainian law tradition of military conflict regulation as a democratic foundation of domestic political and legal opinion from the viewpoint of systemic approach. In this context, it substantiates the main lines of the implementation of the norms of armed conflict law into the national legal field. These lines are based on historic, national and mental specificities of the Ukrainian community.
