Dobosh O. Legal Nature of Power (General-Theoretical Research).

The dissertation deals with the general-theoretical research of power legal nature. The main theories of power origin are revealed and studied on the basis of the analysis of the scientific works of Ukrainian and foreign scientists. The content and features of the concept „power” are determined; the place of this concept in the categorical machinery of theory of state and law is defined. The theoretical-legal analysis of power structure and functions is carried out. The general-theoretical characteristic of power forms, types, levels is proposed. The principles of power formation and functioning are analyzed. The problem of power legality and legitimacy is elucidated in the context of legal state formation. The problems and prospects of implementation of power division theory in Ukraine are investigated. The efficiency factors of power relations in the modern Ukrainian state are distinguished.
