Kondratov D. Criminal-legal protection of privacy of correspondence, telephone conversations, telegraph and other types of correspondence transmitted via communication means or computer

The paper deals with the issues of criminal-legal protection of private correspondence. The analysis of conformity of national legislation concerning legal grounds of restriction of the right to privacy of correspondence produced by the European Court of Human Rights to the principles of limitation of this right is performed. Attention is paid to the analysis of objective and subjective features of the formal components of the crime provided by Article 163 of the Criminal Code of Ukraine, qualifying features for this crime, certain issues of qualification and separation of violation of privacy of correspondence from related criminal offenses. Suggestions directed at the perfection of Art. 163 of the Criminal Code of Ukraine are made.
