Essay

The thesis is a historical and legal research into the rise and development of arbitration tribunals in Ukraine. Archival documents, normative legal acts on judicial system and legal proceedings as well as the place and role of arbitration tribunals in the X-XVIII centuries on the territory of Ukraine have been generalized and systematized. It has been proved that arbitration tribunal was the oldest form of trial, created from the original forms of dispute resolution on the basis of a custom existing on all the lands of the ancient Rus. The kinds of tribunals dealing with cases according to the rules of arbitration and their legal nature at different stages of development have been distinguished. The prevalence of the institute of people's mediators' and arbiters' participation at all stages of a trial have been shown. Peculiarities of appointment and choice of arbiters and mediators and their legal status have been revealed. It has also been pointed out that peaceful settlement was one of the oldest ways of dispute resolution at any stage of a trial.
